These Terms of Service ("Terms") govern your use of applications published by NerdLabs ("we," "us," or "our"), including SmartOptions, CheckMate, ProfitFinder, and QuickFiles (collectively, "the Apps"). By installing or using any of our Apps, you agree to these Terms.
Our Apps are available to Shopify merchants through the Shopify App Store or direct installation. You must have an active Shopify store to use our Apps. You agree to use our Apps only for lawful purposes and in accordance with Shopify's Terms of Service.
When you install an App, we create an account linked to your Shopify store. You are responsible for maintaining the security of your store and any actions taken through the App.
App subscriptions are billed through Shopify's billing system. Prices are listed on each App's listing page and may change with 30 days' notice. Free trials, if offered, are described on the App listing.
You may uninstall any App at any time through your Shopify admin. Uninstalling cancels your subscription. No refunds are provided for partial billing periods, except as required by law.
All Apps, code, designs, and content are owned by NerdLabs. You may not copy, modify, reverse engineer, or distribute any part of our Apps.
Our Apps are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, NerdLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.
Our total liability for any claim arising from your use of an App shall not exceed the amount you paid us in the 12 months preceding the claim.
We strive to keep our Apps available 24/7, but we do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability.
We reserve the right to modify these Terms at any time. Continued use of our Apps after changes constitutes acceptance of the updated Terms.
We may suspend or terminate your access to any App if you violate these Terms or engage in activity that harms our service or other users.
These Terms are governed by the laws of the United States. Any disputes shall be resolved in a court of competent jurisdiction.
